Terms and Conditions for EV Rental

Welcome to Boltfly Technology Solutions Pvt Ltd. By renting or using any electric vehicle (“EV”) provided by Boltfly Technology Solutions Pvt. Ltd. (hereinafter referred to as "the Company"), you agree to comply with and be bound to the following terms and conditions. Please read them carefully before proceeding.

 

1. Eligibility and Registration

  1. You must:
    • Be at least 18 years old (or the minimum legal driving age in your region).
    • Possess a valid driver’s license authorized for the class of vehicle rented.
    • Provide valid identification proof as requested by the Company. (Aadhar, PAN, Voter ID)
  2. You agree to provide accurate, complete, and current information during registration and rental.

2. Documentation Process

  1. Users must provide valid government-issued ID proof during registration.
  2. Clear pictures of required documents must be uploaded on our website/app.
  3. Original documents uploaded must be carried for verification at the time of pickup.
  4. Accepted ID proofs include Aadhar Card, Driver’s License, Passport, etc.
  5. Failure to verify identity may result in service denial and cancellation charges.
  6. For international users, a valid driving license or international driving permit, along with a copy of the passport and visa, are required for high-speed vehicles.
  7. Documentation must be completed within specified time frames (7 days for monthly bookings, 2 days for weekly, and 24 hours for daily). Failure to complete documentation may result in full refund and cancellation of booking.

3. Vehicle Usage

  1. The EV must be used solely for personal transportation and not for commercial purposes (e.g., ridesharing, delivery, racing, or subleasing).
  2. You must comply with all traffic laws, safety regulations, and local ordinances.
  3. You shall:
    • Operate the EV safely and responsibly.
    • Not allow anyone else to drive the vehicle without prior authorization.
    • Not use the EV under the influence of alcohol, drugs, or any illegal substance.
  4. The Company reserves the right to track the EV via GPS for safety, theft prevention, and operational purposes.

4. Rental Period and Charges

  1. The rental period begins when the EV is handed over to you and ends when it is returned in good condition to an authorized Boltfly location or representative.
  2. Rental fees are calculated based on time, distance, or subscription plan as per Boltfly’s pricing policy.
  3. You authorize Boltfly to charge your registered payment method for:
    • Rental fees
    • Late return fees
    • Damage, loss, or penalties (if applicable)
    • Traffic fines or toll violations incurred during the rental period

5. Vehicle Condition and Responsibility

  1. Before accepting the EV, you are encouraged to inspect it for any visible damage or malfunction and immediately report it.
  2. You agree to return the EV:
    • In the same condition as it was provided.
    • With all original accessories (helmet, charger, documents, etc.).
  3. You will be held responsible for:
    • Any damage, theft, or loss of the EV or its accessories during your rental.
    • The cost of repair or replacement as determined by Boltfly.

6. Prohibited Uses

  1. Vehicles cannot be used for illegal activities, rallies, competitions, or modifications.
  2. Minors are not allowed to rent high-speed vehicles.
  3. Carrying sharp objects, weapons, or illegal substances is strictly prohibited.

7. Battery and Charging

  1. The EV must be charged only using the charger and method approved by Boltfly.
  2. Misuse or damage caused by improper charging practices shall be your responsibility.
  3. If provided with a swappable battery, you must ensure it is safely handled and returned.

8. Insurance and Liability

  1. The EV may be covered under limited insurance as per applicable law.
  2. You are liable for:
    • Any deductible or uninsured damages.
    • Violations of law committed during usage.
  3. Boltfly is not liable for:
    • Any loss, injury, or damage caused by your misuse or negligence.
    • Delays, breakdowns, or unavailability of EVs due to technical issues or force majeure.

9. Deposit

  1. Refundable Security Deposits are required for vehicles.
  2. Deposit refunds will be processed within 3-7 working days after returning the vehicle.

10. Assumption of Risk

  1. Users acknowledge and assume all risks associated with operating or riding on our vehicles.
  2. By agreeing to our terms, users release the Company from any liability arising from vehicle usage.

11. Termination and Suspension

Boltfly may suspend or terminate your rental or account if you:

  • Violate these terms.
  • Provide false information.
  • Misuse the EV or cause damage.

You remain liable for all charges incurred before termination.

12. Damage Policy

  1. Users are responsible for any damage to or loss of the vehicle during the rental period.
  2. Charges for damages will be assessed based on the extent of damage.
  3. Damage includes but is not limited to scratches, dents, and mechanical malfunctions.
  4. Users are liable to pay for any repair costs incurred due to damages.
  5. In case of an accident or collision, users may be liable for standard accident insurance charges in case of registered vehicles; however, in case of non-registered and non-insured vehicles, the customers are expected to bear the cost.
  6. The Company reserves the right to withhold the Refundable Security Deposit or charge additional fees for damages exceeding the security deposit amount.
  7. Damage assessment will be conducted by the Company's representatives, and charges will be communicated to the user promptly.
  8. Users are encouraged to report any damages immediately to avoid additional charges.

13. Extra Charges

  1. Additional charges may apply for certain services or situations:
  2. Helmet: Extra helmets can be rented at an additional charge per day, subject to availability.
  3. Excess Kilometers: Charges for exceeding the predefined kilometer limit per booking will be calculated at the time of drop-off or rental period end.
  4. Damages: Charges for damages will be assessed at the time of drop-off, and users will be required to pay for repair costs as per the damage policy.
  5. Extra Battery: Additional batteries can be rented at an extra cost per day, subject to availability.
  6. Charges for extra services or situations will be clearly communicated to the user at the time of booking or extension by our fleet executive.

14. Challan

  1. Users are solely responsible for any traffic violations or fines incurred during the rental period.
  2. In the event of a traffic violation, such as speeding, illegal parking, or running a red light, users will be liable for any associated penalties or fines imposed by the authorities.
  3. The Company may assist authorities in providing user information if required for processing traffic violations.
  4. Users are encouraged to adhere to all traffic regulations and laws to avoid penalties and legal consequences.

15. Payment for Challan Issued for Wrong Side Driving

  1. In the event that a traffic challan is issued against the user for wrong side driving while operating a rented vehicle, the user is obligated to settle the associated fines and penalties.
  2. Users acknowledge that any fines or penalties incurred due to wrong side driving are their sole responsibility, and they agree to promptly reimburse the Company for any payments made on their behalf to settle such fines.
  3. Failure to reimburse the Company for challan payments related to wrong side driving may result in additional charges, suspension of services, or termination of user accounts.
  4. The Company may assist users in providing necessary documentation or information required for contesting or resolving the challan, but ultimate responsibility for payment lies with the user.

16. Prosecution Report

  1. In cases where legal action is initiated against the user due to their actions or negligence while operating the rented vehicle, the Company may provide necessary assistance to law enforcement agencies.
  2. Users agree to cooperate with authorities and provide accurate information regarding the incident leading to legal proceedings.
  3. The Company reserves the right to suspend services or terminate user accounts if found guilty of illegal activities or misconduct leading to prosecution.

17. Vehicle Seizure Case

  1. If a rented vehicle is seized by law enforcement agencies due to the user's involvement in illegal activities or violation of laws, the user will be held responsible for any associated legal consequences and expenses.
  2. Users must immediately inform the Company in such cases and cooperate with authorities to facilitate the release of the vehicle.
  3. The Company may suspend services to the user until the matter is resolved, and any outstanding payments or penalties are settled.

18. Termination of Services

  1. The Company reserves the right to terminate services or suspend user accounts in cases of violation of terms and conditions, fraudulent activities, or safety concerns.
  2. Users will be notified of any such actions taken by the Company, along with the reasons for termination or suspension.
  3. Upon termination of services, users must return any rented vehicles and settle outstanding payments or obligations.

19. Indemnification

You agree to indemnify and hold harmless Boltfly Technology Solutions Pvt. Ltd., its affiliates, and employees from any claims, losses, liabilities, damages, or expenses arising out of your use of the EV or breach of these terms.

20. Data Privacy

Boltfly may collect and process your personal data (e.g., name, contact, GPS data, driving behavior) for operational, legal, and safety purposes in compliance with applicable privacy laws.

21. Termination of Services

  1. The Company reserves the right to terminate services or suspend user accounts in cases of violation of terms and conditions, fraudulent activities, or safety concerns.
  2. Users will be notified of any such actions taken by the Company, along with the reasons for termination or suspension.
  3. Upon termination of services, users must return any rented vehicles and settle outstanding payments or obligations.

22. Dispute Resolution

  1. In the event of any disputes arising from the interpretation or implementation of these terms and conditions, users agree to first attempt to resolve the matter through mutual discussion and negotiation.
  2. If a resolution cannot be reached amicably, both parties agree to submit the dispute to mediation or arbitration in accordance with the laws of the jurisdiction where the Company operates.
  3. Any legal proceedings shall be conducted in the appropriate court or tribunal having jurisdiction over the matter.

23. Governing Law

  1. These terms and conditions shall be governed by and construed in accordance with the laws of Bhubaneswar Court.
  2. Any disputes or legal proceedings arising from these terms shall be subject to the exclusive jurisdiction of the courts in Bhubaneswar.

By availing our services, you agree to abide by these terms and conditions. The Company reserves the right to modify or update these terms at any time without prior notice. It is recommended to review these terms periodically for any changes.
